The plaintiffs claim that Georgia State engages in "systematic, widespread and unauthorized copying and distribution of a vast amount of copyrighted works" through its e-reserves system. Georgia State asserts that its system does not infringe copyright because it falls under copyright´s fair use doctrine. The court has found that the defendants´ use of copyrighted material in e-reserves does not constitute direct or vicarious infringement, but the claim of contributory infringement remains.
